1. Acceptance of these Terms

These Terms govern your use of the $NIKEPIG Meme Machine at https://mememachine.nikepig.com (the "Service"), operated by the $NIKEPIG team ("we", "us", or "our"). By creating an account, buying a plan, or otherwise using the Service you agree to these Terms and to our Privacy Policy and Refund Policy.

2. Description of the Service

The $NIKEPIG Meme Machine is an AI meme generator that lets you create memes starring $NIKEPIG, the meme cast or your own custom mascot, and related creative assets, using artificial-intelligence models. The Service is provided on an "as available" basis and may change, add, or remove features over time.

3. Eligibility and accounts

You must be at least the age of majority in your jurisdiction (and no younger than 16) to create an account or make a purchase.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate account information and to keep it current.
You may not share, sell, or transfer your account to another person.

4. Plans, credits and payment

Paid plans are bought for a fixed period (30 days or one year) and paid on the Cardano blockchain in ADA, NIGHT or $NIKEPIG from a wallet you control. Plans do not renew automatically — a plan runs for the period you bought, then stops. Prices are set in US dollars and converted to the amount of the asset you choose when you pay; the amount shown when you sign the transaction is what you pay. Blockchain transactions cannot be reversed: you are responsible for network fees and for sending the correct amount from your own wallet.

You can upgrade at any time: the value of your unused credits comes off the new price and a fresh period starts when you pay. Moving to a smaller plan applies at the end of your current period. Yearly plans stay yearly until they end.

Plan credits reset to your plan's allowance every 30 days and do not roll over. Bonus credits (for example from a gift code or a referral) are also credits under these Terms. Credits are a non-transferable, non-cashable, cosmetic and progression-only licence with no cash value; they are not money, a security, a token or a crypto asset, are never issued on-chain, and cannot be sold, transferred or redeemed. Paying in $NIKEPIG gives you no ownership, profit or governance interest in any project, we make no statement about the value of any token, and nothing on the Service is financial advice.

5. Acceptable use

You agree not to use the Service to create, upload, or distribute content, or to act, in any way that:

is unlawful, infringing, defamatory, harassing, hateful, or that violates the rights of others;
impersonates a real person, or generates the likeness of a real individual, without their consent, or attempts to depict identifiable public or private persons in a misleading or harmful way;
infringes any third party's intellectual-property, trademark, publicity, or privacy rights;
is sexually explicit, depicts minors inappropriately, or promotes violence or self-harm;
attempts to reverse-engineer, scrape, overload, or circumvent the technical or usage limits of the Service;
resells or sublicenses the Service, or uses it to build a competing product;
uploads a photo of another person without their permission;
harasses or targets private individuals.

We may suspend or terminate access, and remove content, that we reasonably believe violates these rules.

6. Your content

Your uploads. You retain ownership of the images, text, brand descriptions, and other materials you upload ("Your Content"). You represent that you have the rights necessary to upload Your Content and to permit its processing. You grant us a worldwide, non-exclusive licence to host, store, process, and transmit Your Content solely to operate and improve the Service, to generate outputs for you, and as described under "Community gallery and promotion" below. By uploading a mascot, you confirm you own or have permission to use any logos, marks, or branding shown on it.

Generated outputs. Subject to your compliance with these Terms and to the terms of the underlying AI providers, you own the marketing assets and images you generate through the Service and may use them for your business, including commercially. Because AI-generated outputs may be similar across users, we cannot promise that any output is unique or protectable.

Community gallery and promotion. When you create a meme with the Service, you grant our team a worldwide, non-exclusive, royalty-free licence to display, reproduce and share that meme — its image and captions, and the topic and mascot name shown with it — in the public community gallery on the Service and in marketing for the Service, including on our website and social-media accounts (including posts on our X account, @NikePig_ADA). We only publish memes our team has reviewed and approved, and we never show your email address with them. You can opt out at any time: delete the meme from your account (deleting your account also removes the memes saved to it from the gallery), open a support ticket on Discord, or email support@nikepig.com to have a meme removed from the gallery and excluded from future marketing. Opting out does not recall marketing materials already published before your request.

7. Competitions and voting

We may run themed meme competitions. Voting may require signing a message with a Cardano wallet; we check the wallet's $NIKEPIG balance to validate or weight votes. Signing a vote message never moves funds.

8. Third-party services and AI providers

The Service relies on third-party providers (including AI model and image-generation providers and the Cardano network and blockchain-data providers) to function. Your use of the Service is also subject to those providers' terms, and content you submit may be processed by them. See our Privacy Policy for the list of processors and data-retention details.

9. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. AI-generated outputs may contain errors, inaccuracies, or content you did not intend. You are responsible for reviewing outputs before you publish or rely on them.

10. Limitation of liability

To the maximum extent permitted by law, we and our contributors and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid to us for the Service in the three months preceding the event giving rise to the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Termination

You may stop using the Service at any time (see the Refund Policy for how plans end). We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, the licence to your entitlements ends and Sections 9 and 10, and the licence in Section 6 for materials already published, survive.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
